1. About Vietnamatic
Vietnamatic is a travel information, itinerary planning, content-sharing, and travel discovery platform focused on Vietnam. We may provide travel recommendations, maps, guides, user-generated content, booking links, affiliate offers, and related travel services.
Vietnamatic is not a travel agency, tour operator, airline, hotel operator, transportation provider, or travel insurance provider unless specifically stated otherwise.
2. Eligibility
You must be at least 18 years old or have permission from a parent or legal guardian to use the Services.
By using Vietnamatic, you represent and warrant that you have the legal capacity to enter into these Terms, all information you provide is accurate, and you will comply with all applicable laws and regulations.
3. Account Registration
Some features may require an account. You agree to maintain accurate account information, keep your password secure, notify us immediately of unauthorized account use, and be responsible for all activities occurring under your account.
Vietnamatic reserves the right to suspend or terminate accounts at our sole discretion.
4. User Content
Ownership. Users retain ownership of all content they upload, submit, or share through Vietnamatic, including videos, photos, reviews, comments, travel itineraries, blog posts, and other materials ("User Content").
License Granted to Vietnamatic. By uploading or submitting User Content, you grant Vietnamatic a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to host, store, display, reproduce, publish, modify, edit, translate, create derivative works, distribute, promote, market, and publicly perform your User Content in connection with Vietnamatic's business and Services.
This license includes the right to publish User Content on Vietnamatic.com, mobile applications, social media channels, marketing campaigns, email newsletters, video platforms including YouTube, and third-party promotional channels without additional compensation unless otherwise agreed in writing.
User Representations. You represent and warrant that you own or control all rights to User Content, have obtained all required permissions from individuals appearing in the content, User Content does not infringe any copyright, trademark, privacy, publicity, or other rights, and User Content complies with all applicable laws.
5. Content Restrictions
You may not upload or share content that violates laws or regulations, contains hate speech, promotes violence, contains pornography or sexually explicit material, contains malware or harmful code, infringes intellectual property rights, harasses, threatens, or abuses others, or contains false or misleading information.
Vietnamatic may remove content at any time without notice.
6. Copyright Policy (DMCA)
Vietnamatic respects intellectual property rights. If you believe content infringes your copyright, you may submit a notice containing identification of the copyrighted work, identification of the allegedly infringing material, contact information, a statement of good-faith belief, and a statement under penalty of perjury.

Vietnamatic may remove allegedly infringing content and terminate repeat infringers.
7. Travel Information Disclaimer
Travel information provided through the Services is for informational purposes only. Vietnamatic does not guarantee accuracy of travel information, availability of attractions, visa requirements, transportation schedules, weather conditions, or pricing.
Users are responsible for independently verifying travel information.
8. Bookings and Third-Party Services
Vietnamatic may provide links to hotels, airlines, tour operators, transportation providers, travel insurance providers, and affiliate partners. Any transaction between you and a third party is solely between you and that third party.
Vietnamatic is not responsible for reservations, cancellations, refunds, service quality, pricing errors, or third-party actions.
9. Affiliate Disclosure
Vietnamatic may earn commissions from certain bookings, purchases, or referrals made through affiliate links. These commissions do not increase the price paid by users unless otherwise disclosed.
10. Intellectual Property
Except for User Content, all content on the Services including logos, branding, website design, text, graphics, software, databases, maps, and features are owned by Vietnamatic or its licensors.

12. User Conduct
You agree not to use automated bots or scraping tools without permission, attempt unauthorized access to systems, interfere with Service operations, upload viruses or malicious code, circumvent security measures, or impersonate another person or organization.
13. Termination
Vietnamatic may suspend or terminate access to the Services at any time for any reason, including violations of these Terms. Upon termination, your right to use the Services immediately ends.
Sections relating to intellectual property, licenses, limitations of liability, indemnification, and dispute resolution survive termination.
14. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIETNAMATIC DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIETNAMATIC SHALL NOT BE LIABLE FOR INDIRECT DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, TRAVEL LOSSES, OR BUSINESS INTERRUPTION.
IN NO EVENT SHALL VIETNAMATIC'S TOTAL LIABILITY EXCEED USD $100 OR THE AMOUNT PAID BY YOU TO VIETNAMATIC DURING THE PRIOR TWELVE (12) MONTHS, WHICHEVER IS GREATER.
16. Indemnification
You agree to defend, indemnify, and hold harmless Vietnamatic, its owners, officers, employees, contractors, affiliates, and partners from any claims, damages, liabilities, losses, or expenses arising from your use of the Services, your User Content, violation of these Terms, or violation of third-party rights.
17. Governing Law
These Terms shall be governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.
18. Dispute Resolution
Before filing legal action, the parties agree to attempt good-faith resolution through informal negotiation for at least thirty (30) days. If unresolved, disputes may be submitted to binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.
19. Changes to Terms
Vietnamatic may update these Terms from time to time. Updated versions will be posted on the website with a revised effective date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
